Not according to a lawsuit filed last week by the actor Randy Quaid over payments for "Brokeback Mountain," in which he played a small supporting role.

The dispute, one of dozens that annually erupt over pay and practices in the film industry, has been dismissed by some film veterans as a case of sour grapes over a deal that could have been better negotiated for Mr. Quaid.

But others say it points to an uncomfortable contradiction in the specialty divisions owned by the major studios, including Focus Features, Fox Searchlight, Warner Independent, Miramax and others. That is, movies are budgeted as though they were in the independent world, often squeezing every nickel out of actors, directors and production staff, who cut their fees to near nothing for the privilege of making a picture they are passionate about.

When it comes to releasing the film, however, the "arthouse" divisions can take advantage of the deep pockets of their studio parents, frequently spending tens of millions of dollars to promote a movie to glory or box office success in the award season.

"There is a trap in there somewhere, with the specialty divisions working in bigger and bigger contexts, trying to get bigger numbers," said Ira Deutchman, president of Emerging Pictures, and a longtime player in the independent world.

In his lawsuit, Mr. Quaid claims he was tricked into accepting a tiny (unspecified) fee for the part of Joe Aguirre, the rancher who hires the shepherds played by Heath Ledger and Jake Gyllenhaal, because the director, Ang Lee, told him the movie was being made on a shoestring budget by Focus, the arthouse division of Universal Studios. And while the production budget was very low, $14 million according to documents filed in Canada where the movie was shot, the lawsuit claims that Focus knew all along that it would throw millions — $30 million, according to the complaint — into marketing the film.

The complaint says that the defendants, in this case Focus and its recent co-presidents David Linde and James Schamus, "have enriched themselves to the tune of approximately $160 million in worldwide gross box office receipts on the back of actors who were convinced to cut their fees purportedly to ensure that the film reached the screen." Far from being a labor of love, it says, the picture was a "movie laundering" scheme that "in reality, had studio backing and would be exploited using traditional studio marketing and distribution techniques."

A Focus representative declined to comment on the lawsuit, citing a policy against discussing pending litigation.

To be sure, Mr. Quaid's role in the Oscar-winning film was tiny, and few would attribute the success of "Brokeback" to the handful of minutes he spends on screen.

But the disparity between actors' fees and the film's promotional budget points toward what may be an endemic problem for the specialty divisions: even actors whose contracts provide for profit participation in successful films may find there is no profit left in which to participate, while the studios still collect rich distribution fees.

"It's a complicated question, and it is both the genius and the nefarious nature of these mini-majors," said Linda Lichter, a lawyer who sells films in the independent world. "The purpose of those mini-majors is to try to make movies that the major studios can't afford to make, for less money. But they don't make those movies unless they get big players who are willing to cut their price." On the other hand, "Randy Quaid had a tiny part," she said, adding, "There's an aspect here of biting the hand that feeds him."

Another veteran entertainment lawyer, Susan Bodine, said it was typical for actors who took low fees for arthouse movies to be given points in the net profits of a film. But, she pointed out, "as a general matter, net profit participants on studio-released films, even low-budget films, can be nothing, even when the film does really well." She said it was too early to know if that would be the case with "Brokeback Mountain." But in the Oscar season, "the better the film does, the more they spend on it, the less likely there'll ever be any net profit." (Ms. Bodine represents Mr. Schamus, in private matters, but did not have any dealings on "Brokeback Mountain.")

That would seem to be the case with some of the films that made it to the best picture category this year at the Oscars. "Good Night, and Good Luck," from Warner Independent, cost a mere $8 million to produce, with the actors earning the lowest permissible union fee, known as scale, an executive involved in the film said. Warner Brothers spent about $25 million to promote the film for the Oscars and in its general release, so while the movie took in $51 million around the world, there will be no profit to share in, the executive said. (Distributors share box office revenue with theater owners.)

Similarly, "Crash," which cost $6.5 million to produce, and was released by Lionsgate, has taken in $90.8 million around the world. So far, the movie's main participants, who deferred their fees to get the movie made, have seen only minimal payments, said an executive involved in its release. The lack of payment to one producer has kicked up a lawsuit against Bob Yari, who put together the film's financing.

Some in Hollywood defended Focus against Mr. Quaid's claims, though they declined to speak on the record so as not to affect their own business relationships. An executive from another arthouse studio, for instance, said that these companies could not function without actors working for low fees, since the vast majority of their films were not successful commercially or otherwise. The executive said that the most prominent actors were granted bonus fees for successful films, or a cut of the adjusted gross box-office receipts.

Several pointed out that Focus could not have known that its gay-themed love story would become the success that it eventually did, and did not set out to deceive Mr. Quaid. A lawyer for Mr. Quaid, who is seeking $10 million in damages, would not comment on his deal, although the complaint notes that the actors were paid a total of $521,000 for their work on the film.

But Mr. Deutchman, the Emerging Pictures president, said the lawsuit illuminated a problem that could lead to actors and other talent becoming more reluctant to sign on to arthouse movies made at the studios. "If, in fact, the smaller movies don't pay off for talent even when they hit, the studio arthouse divisions will stop being able to make the movies," he said. "They'll fall into the same trap as the parent companies: if no one believes there's a back end, then actors will want higher and higher salaries to be in those movies."

Ah, even when there's "only a few million dollars" at stake, things get so complicated you need a devious mind to figure it out. Surprise, surprise.

Thanks, Ethan, for the article you posted. Things are in perspective now. Always the same old story, how can the fewest number pocket the biggest sum. Mr Quaid isn't any greedier than the next person in the film industry ; he just happened to have 2 minutes in one of the greatest films in history. Of course he's going to try to get more of the profit. Probably needs it to pay for a new mansion.

Sorry, I cannot see this incident with any humour.  :(

You are welcome, Stephan. I share the same sentiment with you. It is very unfortunate. It is good that I never like Joe Aquirre in the movie so it makes easier to watch the DVD.

Thanks for the article. I'm still annoyed by this. IMO there were many different reasons people went to see this movie and Randy Quaid wasn't one of them.

Stephan- my friend said something similar- that he needed to buy a new summer home and that's why he's complaining.  :)

I probably missed this but does anyone have any idea what Jake and Heath were paid for BBM..when I think of the millions of dollars that Tom Cruise, Julia Roberts and others get for some of their "trash" and I imagine that our boys probably got nothing even close to that it makes me crazy...they deserve 20M each for their performances.......I hope that at least in their future roles they are paid competetively..I know it's not all about money......

I wouldn't think they were paid much at all Bubbaluna,not by todays standards.If the figure of $521,000 was the pay for the whole cast then it was minimal.No doubt they have recouped revenue from promotion etc,but the work they did creating such a mind blowing film will be remembered for all time as a work of love

Brokeback Mountain is a movie with a great story. The actors and their abilities brought the characters to life for us to the point where many of us identify with one or more of those characters. Brokeback Mountain for one or more reasons has come alive for us and we have fallen in love with it.

When a person loves someone or something it is only natural to want to defend that someone or something when we think it is being attacked or somehow cheapened. That, after all, is a part of loving. But love can make us blind to other perspectives.

Jake Gyllenhaal and Heath Ledger both said they wanted to participate in this movie because they fell in love with the characters and because it was a story that had never been told and needed telling.

Annie Proulx said that when she was writing the story the characters came alive to her as no other characters she had written about ever did.  She said she especially loved Ennis.

We, the viewers, because of all those things and more, have fallen in love with Brokeback Mountain. But, because of that love, we forget that not everyone is in love with it.  For some, Brokeback Mountain was simply a job. A means to make a living by using their talents.

Randy Quade is one of those people.  He was approached by director and studio to see if he wanted a job.  He claims he was told it would be a low budget “arts” film with a limited audience (mostly gay) and would play in “arts” movie houses where the ticket prices range from one dollar to five dollars a ticket.  At those prices there would be little profit if any from a limited audience. It was, in fact, a low budget film at a reported fourteen million dollars.

With the filming being completed and the film now in post production the word was spreading rapidly about this “gay cowboy” movie called Brokeback Mountain. The gay community was excited about it and the Christian right was sure the devil had a hand in its production. Much was written about it from both sides and everywhere in between. 

With the movie finished, it went to the film festivals where it was generally well received as an excellently made film.  There were glowing reviews and reviews of damnation. There was a great deal of “buzz” about Brokeback Mountain in movie circles.  So much so that first-run movie houses started to show an interest.

So much interest was shown that the studio decided they may not have just an “arts” film here and decided to distribute it to a very limited number of first-run theaters where the ticket prices ranged from six dollars to twelve dollars a ticket.  If the movie went well in these theaters there was great potential for this movie making a good profit.

Well, Brokeback Mountain did do well in these theaters so the studio decided to slowly increase the number of theaters that would show the movie. First-run movie houses were calling and asking for the movie; something never expected. The studio also decided to promote the movie more than they had originally planned.  While Brokeback Mountain was by no means a “blockbuster”, it did very well for a movie with it’s subject matter and with a simulated gay sex scene in it.

But where does that leave us?  The movie was not expected to be this famous or popular and the actors already agreed to take less than their usual fees for an “arts” film which didn’t end up being an “arts” film at all and was never promoted as an “arts” film.

One man, a professional in his trade, asked the question, why should the studio and producers make huge profits from this film when he was asked to reduce his fees “because the movie probably wouldn’t make any money.”  No matter how you feel about the movie this is a good question. Don’t ALL the actors deserve their honest pay from a movie that has made so much? Do the producers and studio really have to make big bucks off of the labor of notable and good actors who were not paid what they were really worth?

Randy is suing for ten million dollars and that seems to have us outraged.  But, we should remember that most times people sue for a LOT more than they really want knowing there will probably be a settlement to the fairer amount. Randy just wants what his skills have gotten him in the past. The money is there to pay him that and ALL the actors what they are worth. Why should the producers and studio keep it?

Put yourself into Randy’s shoes.  Someone comes to you and says they need someone with your skills but they can’t pay much because the project probably won’t make any money.  You like the project and agree to take fifty dollars a day when you are use to making three hundred dollars a day.  When it is all finished you find out the company that hired you made an enormous profit.  Wouldn’t you be a little upset? Be honest with yourself at least.

Of course, reality doesn’t make those of us who love Brokeback Mountain feel much better as we watch our love being attack and smeared. We feel the need to defend it and attack those who are doing the attacking and smearing of our beloved Brokeback Mountain and through it, our two young lovers who we love so, so, much.

But Randy isn’t a bad guy.  He is just a nice guy, and a good enough actor that Ang Lee wanted him, who agreed to take less than his normal fee for doing a job in a project that was suppose to be a financial flop, because it was supposed to be promoted as an “arts” film but instead was promoted as a major motion picture.

In my view, now that the producers changed the “type” of film from “arts” to major, and since the movie has made major money, the producers should stop being so greedy and pay ALL the actors what they are worth and then, together, celebrate the making of a film that has touched the hearts and lives of so many people around the world.

Let’s not even discuss the possibility of the studio and producers planning to promote the film as a major motion picture from the very beginning instead of an “Arts” film.

Perhaps Randy is using BBM to get his fame regardless of the outcome of the lawsuit.

It is indeed a bad taste. We can really scratch Randy Quaid from BBM then and oh his brother who made some lame joke at SAG.

Apparently tackiness runs in the family - maybe Randy Quaid as Aguirre wasn't such a stretch.

And, as Froggy pointed out, he was on camera for like 5 minutes.

This is more pathetic than anything else, IMHO.

Okay, my main problem with it was that he asking for so much money. I mean, that seemed like more than anyone would pay Randy Quaid for such a small role. You make a lot of sense with the suing for way more than you expect to get thing, though. I never even thought about that.

I doubt that the producers were planning from the start to market it as a major motion picture. When I first heard about and saw it advertised, I was under the impression that it was an "Arts" film. The only place I had seen it advertised was the "Arts" theater downtown, and it just didn't seem like a movie that would be playing at AMC. I was shocked to see it playing there. It looked like most of the movies in my collection at home, but like none of the movies that I had seen in a regular theater.

Good point, bram.  I don't see Roberta Maxwell or Peter McRobbie filing suits.  Besides, many acting contracts are written with % of profits clauses - Quaid could have done that; he's been around for years and knows the game well.  Stop your whining, Randy.

I have always known I do not fit in as a member of the straight community. But being a member of this forum has also shown me that I do not fit in as a member of the gay community. My thoughts, perceptions, ideas and the way I see things are so different from those of others here.

I am not sure what the above statement has to do with this topic, perhaps you just felt you needed to say it. However, for the rest of your comments and for Mr. Quaid, I have only 1 question:

Was a contract signed?

If so, all parties must abide by the agreed upon terms. I doubt anyone will ever see the contract except the lawyers of all concerned parties.

I would like to hear from someone who is familiar with the film industry regarding the options given actors in a film. Are they not given the option of either a flat salary or taking a % of profits? Further, are they not given an option for future earnings such as DVD sales?

I think Randy pretty much shot himself in the foot for any chance of sharing any future profits. But again, perhaps he was ill advised or simply had a low expectation of the film himself that influenced the bottom line option he agreed upon for both the film and DVD sales.

Quaid, who filed a $10 million (all figures U.S.) against Focus Features in March seeking a cut of the movie’s box office profits, insisted the studio agreed to pay him a bonus. A rep for the actor said Tuesday it was an informal agreement between lawyers for both sides.

But Focus Features claims in a statement it never “negotiated, offered or agreed to any settlement agreement.”

Brokeback Mountain, starring Jake Gyllenhaal and Heath Ledger as sheep herders who fall in love after being hired by Quaid’s character, has grossed about $160 million worldwide.

This is the best resolution for this.  He redeems himself a bit by choosing to settle quietly.  He is not stupid to not know how he has aleinated BBM lovers by his actions.

I'm just glad to see a "settlement" of some sort has been reached.  Maybe someone in Quaid's camp finally got him to realize how potentially harmful this suit could have been to his career.

Indeed Patriot1.  Alas, I interpret this as face-saving.  Had this been the original intention, it would have been stipulated in the original suit.  He was mercifully advised to make the most of a bad situation.  And as the articles said, Focus is mystified by the turn of events.  The other actors did not join him in the suit.  His gesture, though thoughtful and considerate, was more for himself and his image, rather than for the other actors.

You can play magnanimous in the face of almost universal condemnation.
